Article 258 of the French Customs Code

1° The following are also reserved for ships operated by shipowners who are nationals of a Member State of the European Community or of another State party to the Agreement on the European Economic Area, registered in a Member State of the European Community or in another State party to the Agreement on the European Economic Area and flying the flag of that same State:

a) Between ports in the same French overseas department ;

b) Between ports in the departments of Guadeloupe, French Guiana and Martinique;

c) Between ports in the departments of Mayotte and La Réunion.

2° The administrative authority may reserve, under conditions laid down by decree, for the vessels mentioned in 1°, the carriage of certain goods carried out :

a) Between the ports of the French overseas departments and those of mainland France ;

b) Between the ports of Réunion and the other French overseas departments.

3° However, by way of derogation from the provisions of 1° and 2°, the local maritime affairs departments concerned may authorise a vessel that does not meet the conditions of 1° to carry out a specific transport operation.

Article 258

1° Sont également réservés aux navires exploités par des armateurs ressortissants d’un Etat membre de la Communauté européenne ou d’un autre Etat partie à l’accord sur l’Espace économique européen, immatriculés dans un Etat membre de la Communauté européenne ou dans un autre Etat partie à l’accord sur l’Espace économique européen et battant pavillon de ce même Etat, les transports effectués :

a) Entre les ports d’un même département français d’outre-mer ;

b) Entre les ports des départements de la Guadeloupe, de la Guyane et de la Martinique ;

c) Entre les ports des départements de Mayotte et de La Réunion.

2° L’autorité administrative peut réserver, dans des conditions fixées par décret, aux navires mentionnés au 1°, les transports de certaines marchandises effectués :

a) Entre les ports des départements français d’outre-mer et ceux de la France métropolitaine ;

b) Entre les ports de la Réunion et des autres départements français d’outre-mer.

3° Toutefois, par dérogation aux dispositions prévues aux 1° et 2°, les services des affaires maritimes locaux concernés peuvent autoriser un navire ne satisfaisant pas aux conditions du 1° à assurer un transport déterminé.
