I. – The following shall be submitted to the director of the registry of the court that rendered the decision, approved the agreement or endorsed the future protection mandate:
1° Applications for the certification of French enforceable titles with a view to their recognition and enforcement abroad pursuant to:
– Articles 45 to 58 and 61 of Regulation (EU) No 650/2012 of the European Parliament and of the Council of 4 July 2012 on jurisdiction, applicable law, recognition and enforcement of decisions and the acceptance and enforcement of authentic instruments in matters of succession and the creation of a European Certificate of Succession;
– Articles 44 to 57 and 60 of Council Regulation (EU) No 2016/1103 of 24 June 2016 implementing enhanced cooperation in the area of jurisdiction, applicable law, recognition and enforcement of decisions in matters concerning matrimonial property regimes;
– of Articles 44 to 57 and 60 of Council Regulation (EU) No 2016/1104 of 24 June 2016 implementing enhanced cooperation in the area of jurisdiction, applicable law, recognition and enforcement of judgments in matters of property effects of registered partnerships;
– of Council Regulation (EC) No 44/2001 of 22 December 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters ;
– of Regulation (EU) No 1215/2012 of the European Parliament and of the Council of 12 December 2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters;
– of Article 39 of Council Regulation (EC) No 2201/2003 of 27 November 2003 concerning jurisdiction and the recognition and enforcement of judgments in matrimonial matters and the matters of parental responsibility, repealing Regulation (EC) No 1347/2000 ;
– of Article 36 of Council Regulation (EU) 2019/1111 of 25 June 2019 concerning jurisdiction and the recognition and enforcement of judgments in matrimonial matters and the matters of parental responsibility as well as international child abduction (recast);
– the Convention on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters, done at Lugano on 30 October 2007;
2° Applications for the purposes of obtaining an extract from a decision submitted pursuant to Article 28(1) of Council Regulation (EC) No 4/2009 of 18 December 2008 on jurisdiction, applicable law, recognition and enforcement of decisions and cooperation in matters relating to maintenance obligations.
3° Applications for the issue of the certificate referred to in Article 38 of the Hague Convention of 13 January 2000 on the International Protection of Adults.
II. – The following shall be submitted to the judge who rendered the decision or approved the agreement:
1° Applications for the certification of French enforceable titles with a view to their recognition and enforcement abroad pursuant to:
– Articles 41 and 42 of Council Regulation (EC) No 2201/2003 of 27 November 2003 concerning jurisdiction and the recognition and enforcement of judgments in matrimonial matters and the matters of parental responsibility, repealing Regulation (EC) No 1347/2000;
– Article 47 of Council Regulation (EU) 2019/1111 of 25 June 2019 concerning jurisdiction and the recognition and enforcement of judgments in matrimonial matters and the matters of parental responsibility, as well as international child abduction (recast);
– Regulation (EC) No 805/2004 of the European Parliament and of the Council of 21 April 2004 creating a European Enforcement Order for uncontested claims;
– Articles 5, 9 and 14.1 of Regulation (EU) No 606/2013 of the European Parliament and of the Council of 12 June 2013 on the mutual recognition of protection measures in civil matters;
2° Requests for the purposes of obtaining an extract from a decision submitted pursuant to Article 20(1) of Council Regulation (EC) No 4/2009 of 18 December 2008 on jurisdiction, applicable law, recognition and enforcement of decisions and cooperation in matters relating to maintenance obligations.
Applications submitted to the judge do not require the assistance of a lawyer.
III. – Applications for the certification of French enforceable titles with a view to their recognition and enforcement abroad pursuant to Article 66 of Council Regulation (EU) 2019/1111 of 25 June 2019 concerning jurisdiction and the recognition and enforcement of judgments in matrimonial matters and the matters of parental responsibility as well as international child abduction (recast) shall be submitted to the president, or his delegate, of the judicial court :
– in whose jurisdiction the authentic instrument was received, or
– in whose jurisdiction the instrument under private signature countersigned by lawyers was deposited in the minutes of a notary, or
– whose registry has affixed the executory formula to the agreement.
