Article 728-35 of the French Code of Criminal Procedure

The competent public prosecutor is the one in whose jurisdiction the last known residence of the convicted person is located, the place where the person is held in custody or the place where the offence was committed when part of the offence was committed on French territory. Failing this, the public prosecutor at the Paris judicial court has jurisdiction.

If the public prosecutor to whom the request has been sent by the convicting State for the purposes of recognition and enforcement does not have jurisdiction, he will forward it without delay to the competent public prosecutor. The competent authority of the convicting State shall be informed of the transmission.

Le procureur de la République compétent est celui dans le ressort duquel se situe la dernière résidence connue de la personne condamnée, le lieu de détention de celle-ci ou le lieu de l’infraction lorsque les faits ont été commis pour partie sur le territoire français. A défaut, le procureur de la République près le tribunal judiciaire de Paris est compétent.


Si le procureur de la République auquel la demande a été adressée par l’Etat de condamnation aux fins de reconnaissance et d’exécution n’est pas compétent, il la transmet sans délai au procureur de la République compétent. L’autorité compétente de l’Etat de condamnation est informée de la transmission.
