Article 728-43 of the French Code of Criminal Procedure

The public prosecutor shall recognise the sentencing decision as enforceable on French territory in the absence of one of the grounds for refusal provided for in Articles 728-32 and 728-33.

In the event that, pursuant to 3° of article 728-11, the consent of the competent authority of the executing State is required, the public prosecutor shall assess whether it is appropriate to give it, considering, in particular, the interest of his decision for the social rehabilitation of the sentenced person.

Where the consent of the sentenced person is required pursuant to the same 3°, the public prosecutor shall expressly state, in the decision recognising the sentencing decision as enforceable, that it has been given.

The decision of the public prosecutor refusing to recognise the sentencing decision as enforceable on French territory shall state the reasons.

Article 728-43

Le procureur de la République reconnaît la décision de condamnation comme étant exécutoire sur le territoire français en l’absence de l’un des motifs de refus prévus aux articles 728-32 et 728-33.

Dans le cas où, en application du 3° de l’article 728-11, le consentement de l’autorité compétente de l’Etat d’exécution est requis, le procureur de la République apprécie s’il y a lieu de le donner en considérant, notamment, l’intérêt de sa décision pour la réinsertion sociale de la personne condamnée.

Dans le cas où le consentement de la personne condamnée est requis en application du même 3°, le procureur de la République constate expressément, dans la décision reconnaissant la décision de condamnation comme exécutoire, qu’il a été donné.
