Article 728-55 of the French Code of Criminal Procedure

The public prosecutor will immediately inform the competent authority in the sentencing State of the final decision taken on the recognition and enforcement of the sentencing decision and, where appropriate, on the adaptation of the custodial sentence or detention order. Where the final decision consists of a refusal to recognise and enforce the sentencing decision or involves an adaptation of the custodial sentence or detention order, the public prosecutor will also inform the competent authority in the sentencing State of the reasons for the decision.

Where, after adaptation of the custodial sentence or the custodial security measure and deduction from its duration of the deprivation of liberty already undergone, the sentencing decision is to be regarded as having been enforced in full, the public prosecutor shall inform the competent authority of the sentencing State that the sentenced person may not be imprisoned in France in enforcement of that decision and that, in the event of transfer, he or she will be released immediately upon arrival on French soil.

Le procureur de la République informe sans délai l’autorité compétente de l’Etat de condamnation de la décision définitive prise sur la reconnaissance et l’exécution de la décision de condamnation et, le cas échéant, sur l’adaptation de la peine ou de la mesure de sûreté privative de liberté. Lorsque la décision définitive consiste en un refus de reconnaissance et d’exécution de la décision de condamnation ou comporte une adaptation de la peine ou de la mesure privative de liberté, le procureur de la République informe également l’autorité compétente de l’Etat de condamnation des motifs de la décision.

Lorsque, après adaptation de la peine ou de la mesure de sûreté privative de liberté et imputation sur la durée de celle-ci de la privation de liberté déjà subie, la décision de condamnation doit être regardée comme intégralement exécutée, le procureur de la République informe l’autorité compétente de l’Etat de condamnation que la personne condamnée ne pourra pas être écrouée en France en exécution de cette décision et que, en cas de transfèrement, elle sera mise immédiatement en liberté à son arrivée sur le sol français.
