Article 763-7 of the French Code of Criminal Procedure

When a person sentenced to socio-judicial supervision including a treatment order is to undergo a custodial sentence, he or she shall serve this sentence in a prison provided for by the third paragraph of article 717-1 and enabling him or her to receive appropriate medical and psychological supervision.

She is immediately informed by the sentence enforcement judge of the possibility of undergoing treatment. If she does not agree to undergo treatment, this information is renewed at least once every year.

In the event of suspension or splitting of the sentence, placement outside without supervision or a semi-liberty measure, the obligations resulting from the socio-judicial supervision are applicable.

Lorsqu’une personne condamnée à un suivi socio-judiciaire comprenant une injonction de soins doit subir une peine privative de liberté, elle exécute cette peine dans un établissement pénitentiaire prévu par le troisième alinéa de l’article 717-1 et permettant de lui assurer un suivi médical et psychologique adapté.

Elle est immédiatement informée par le juge de l’application des peines de la possibilité d’entreprendre un traitement. Si elle ne consent pas à suivre un traitement, cette information est renouvelée au moins une fois tous les ans.

En cas de suspension ou de fractionnement de la peine, de placement à l’extérieur sans surveillance ou de mesure de semi-liberté, les obligations résultant du suivi socio-judiciaire sont applicables.
