Article 779 of the French Code of Criminal Procedure

A decree in the Conseil d’Etat shall determine the measures necessary for the implementation of articles 768 to 778, and in particular the conditions under which bulletins no. 1, 2 and 3 of the criminal record must be requested, drawn up and issued.

This Regulation also determines the conditions under which the information recorded by the automated national criminal record may be used for the enforcement of criminal sentences.

This decree also organises the procedures for transmitting information between the automated national criminal record and the persons or services that have access to it.

The aforementioned decree in the Council of State is issued after receiving the opinion of the National Commission for Information Technology and Civil Liberties.

Article 779

Un décret en Conseil d’Etat détermine les mesures nécessaires à l’exécution des articles 768 à 778, et notamment les conditions dans lesquelles doivent être demandés, établis et délivrés les bulletins n° 1, 2 et 3 du casier judiciaire.

Ce règlement détermine également les conditions dans lesquelles les informations enregistrées par le casier judiciaire national automatisé peuvent être utilisées pour l’exécution des sentences pénales.

Ce décret organise en outre les modalités de transmission des informations entre le casier judiciaire national automatisé et les personnes ou services qui y ont accès.

Le décret en Conseil d’Etat susvisé est pris après avis de la commission nationale de l’informatique et des libertés.
