Article A143-2 of the French Insurance Code

I.-In application of article L. 143-2-2, members of a contract referred to in the first paragraph of article L. 381-1 and guaranteed by a supplementary professional retirement fund shall be provided, on request, within a period not exceeding one month:

-the management report and annual accounts relating to the auxiliary allocation account(s) referred to in articles L. 143-4 and L. 381-2 ;

-the report indicating the investment policy and the corresponding technical and financial risks referred to in article L. 143-2-2;

-the procedures for exercising the transfer;

-the amount due if the surrender option is exercised when one of the events referred to in article L. 132-23;

-in the case of unit-linked policies where an investment option is active, additional information on this investment option and the corresponding underlying assets;

-a description of the options available to members to obtain payment of their benefits;

-the level that retirement benefits must reach, where applicable, as well as information on the assumptions used to estimate the amounts expressed as life annuities, in particular the technical rate, the type of benefit and the average duration of the annuity according to the table used.

The statement provided for in article L. 132-22 specifies how the information referred to in this I is to be obtained.

II – Each year, as part of the information provided for in Article L. 132-22, policyholders receive brief information on the situation of the insurance company or the supplementary occupational pension fund and on the level of funding of the pension scheme as a whole.

III -When the employee liquidates his pension rights or when other benefits become due, the insurance undertaking or the supplementary occupational pension fund will send him, or the beneficiary where applicable, within two months, adequate information on the benefits due to him and on the corresponding payment options.

Article A143-2

I.-En application de l’article L. 143-2-2, sont remis sur demande aux adhérents d’un contrat mentionné au premier alinéa de l’article L. 381-1 et garanti par un fonds de retraite professionnelle supplémentaire, dans un délai qui ne peut excéder un mois :

-le rapport de gestion et les comptes annuels relatifs à la ou aux comptabilités auxiliaires d’affectation mentionnées aux articles L. 143-4 et L. 381-2 ;

-le rapport indiquant la politique de placement et les risques techniques et financiers correspondants mentionné à l’article L. 143-2-2 ;

-les modalités d’exercice du transfert ;

-le montant dû en cas d’exercice de la faculté de rachat lorsque survient l’un des événements mentionnés à l’article L. 132-23 ;

-pour les contrats dont les garanties sont exprimées en unités de compte et pour lesquels une option d’investissement est active, des informations supplémentaires sur cette option d’investissement et les supports correspondants ;

-une description des options à la disposition des affiliés pour obtenir le versement de leurs prestations ;

-le niveau que les prestations de retraite doivent atteindre, le cas échéant, ainsi que des informations sur les hypothèses utilisées pour estimer les montants exprimés en rente viagère, en particulier le taux technique, le type de prestation et la durée moyenne de la rente selon la table utilisée.

Le relevé prévu à l’article L. 132-22 précise les modalités d’obtention des informations du présent I.

II.-Les assurés reçoivent chaque année, dans le cadre de l’information prévue à l’article L. 132-22, des informations succinctes sur la situation de l’entreprise d’assurance ou du fonds de retraite professionnelle supplémentaire ainsi que sur le niveau de financement du régime de retraite dans son ensemble.

III.-Lorsque le salarié fait liquider ses droits à la retraite ou que d’autres prestations deviennent exigibles, l’entreprise d’assurance ou le fonds de retraite professionnelle supplémentaire lui adresse, ou au bénéficiaire le cas échéant, dans un délai de deux mois, une information adéquate sur les prestations qui lui sont dues et sur les options de paiement correspondantes.
