Article A212-223 of the French Sports Code

In the context of freedom of establishment, when the Minister responsible for sport considers, after obtaining the opinion of the permanent mountaineering section of the training and employment commission of the Higher Council for Mountain Sports, that there is a substantial difference, he refers the matter to the commission for the recognition of qualifications mentioned in article R. 212-84, attaching the opinion of the permanent section to the file. After ruling on the existence of a substantial difference, the Commission for the Recognition of Qualifications proposes, where appropriate, to the Minister for Sport that the applicant be subjected to all or part of the aptitude test provided for in article R. 212-90-1.

Dans le cadre de la liberté d’établissement, lorsque le ministre chargé des sports estime, après avis de la section permanente de l’alpinisme de la commission de la formation et de l’emploi du Conseil supérieur des sports de montagne, qu’il existe une différence substantielle, il saisit la commission de reconnaissance des qualifications mentionnée à l’article R. 212-84, en joignant au dossier l’avis de la section permanente. Après s’être prononcée sur l’existence d’une différence substantielle, la commission de reconnaissance des qualifications propose, le cas échéant, au ministre chargé des sports de soumettre le déclarant à tout ou partie de l’épreuve d’aptitude prévue à l’article R. 212-90-1.
