Article A37-15 of the French Code of Criminal Procedure

Where, in accordance with the provisions of the third paragraph of I of Article R. 49-1 or the last paragraph of article R. 49-10, the offence is recorded by the ticketing officer under conditions that do not allow the ticket and payment card to be issued immediately, in particular because the official report is drawn up using the device provided for in Article A. 37-19, the following documents shall be sent by post to the offender’s home address or, where the offender’s identity cannot be established, to the home address of the holder of the registration certificate:

-a notice of offence;

-a payment notice;

a request for exoneration form on a separate sheet, where the information relating to the procedures for contesting and appealing is not included on the notice of offence.

The characteristics of these documents are set out in the articles A. 37-16 to A. 37-18.

When the official report recording the offence is drawn up in the offender’s absence, a document informing him that he will receive a notice of the fine at his home address may be left on the vehicle. Failure to leave this document, however, does not constitute grounds for invalidating the procedure.

Article A37-15

Lorsque, conformément aux dispositions du troisième alinéa du I de l’article R. 49-1 ou du dernier alinéa de l’article R. 49-10, la contravention est constatée par l’agent verbalisateur dans des conditions ne permettant pas l’édition immédiate de l’avis de contravention et de la carte de paiement, notamment parce que le procès-verbal de constatation est dressé avec l’appareil prévu par l’article A. 37-19, il est adressé par voie postale au domicile du contrevenant ou, lorsque son identité n’a pu être établie, au domicile du titulaire du certificat d’immatriculation les documents suivants :

-un avis de contravention ;

-une notice de paiement ;

-un formulaire de requête en exonération sur un feuillet distinct, lorsque les informations relatives aux modalités de contestation et de recours ne figurent pas sur l’avis de contravention.

Les caractéristiques de ces documents sont fixées par les articles A. 37-16 à A. 37-18.

Lorsque le procès-verbal constatant l’infraction est dressé en l’absence du contrevenant, un document l’informant qu’il recevra à son domicile un avis de contravention peut être laissé sur le véhicule. La non-dépose de ce document ne constitue toutefois pas une cause de nullité de la procédure.
