Article A761-13 of the French Commercial code

In its response to the referral provided for in Article R. 761-12, the manager of the national interest market shall inform the prefect whether or not it has surfaces and facilities corresponding to the request.

If it has these areas, it provides the prefect with a proposal for installation comprising:

– a plan of the location of these areas within the market enclosure;

– the characteristics of the land or property facilities that it can make available;

– the market’s internal regulations;

– the conditions for making fluids and waste and wastewater treatment available;

– the financial conditions for making the land or premises available.

The response is sent to the prefect by registered letter with acknowledgement of receipt.

Dans sa réponse à la saisine prévue à l’article R. 761-12, le gestionnaire du marché d’intérêt national indique au préfet s’il dispose ou non de surfaces et installations correspondant à la demande.

S’il dispose de ces surfaces, il fournit au préfet une proposition d’installation comportant :

– un plan de localisation de ces surfaces dans l’enceinte du marché ;

– les caractéristiques des terrains ou des installations immobilières qu’il peut mettre à sa disposition ;

– le règlement intérieur du marché ;

– les conditions de mise à disposition des fluides et de traitement des déchets et des eaux usées ;

– les conditions financières de mise à disposition des terrains ou locaux.

La réponse est transmise au préfet par voie de lettre recommandée avec demande d’avis de réception.
