Article A761-2 of the French Commercial code

The standard application for early declassification of the national interest market contains, in addition to the deliberation of the regional council concerned, the following documents:

1° The deliberation of the commune or the public establishment for inter-communal cooperation on whose territory the market of national interest is located;

2° An economic and financial report setting out the reasons for the request, in particular a loss-making management of the said market or the finding that it no longer complies with the general organisational provisions laid down by articles R. 761-13 et seq.

The file is sent to the regional prefect, who forwards it to the supervisory ministers with his opinion.

Le dossier type de demande de déclassement anticipé du marché d’intérêt national contient, outre la délibération du conseil régional intéressé, les pièces suivantes :

1° La délibération de la commune ou de l’établissement public de coopération intercommunale sur le territoire desquels est implanté le marché d’intérêt national ;

2° Un rapport économique et financier exposant les motifs de la demande, notamment une gestion déficitaire dudit marché ou le constat que celui-ci n’est plus conforme aux dispositions d’organisation générale édictées par les articles R. 761-13 et suivants.

Le dossier est adressé au préfet de région, qui le transmet aux ministres de tutelle avec son avis.
