Article D1233-14-3 of the French Labour Code

In the event of a decision to refuse validation or homologation, the social and economic committee is consulted prior to the new application on the collective agreement or unilateral document after the necessary amendments have been made.

The amended draft and the opinion of the social and economic committee are forwarded to the administration by any means capable of conferring a date certain.

En cas de décision de refus de validation ou d’homologation, le comité social et économique est consulté préalablement à la nouvelle demande sur l’accord collectif ou le document unilatéral après que les modifications nécessaires ont été apportées.

Le projet modifié et l’avis du comité social et économique sont transmis à l’administration par tout moyen permettant de conférer une date certaine.
