Article D1233-4 of the French Labour Code

The notification of the redundancy project provided for in article L. 1233-46 is sent by electronic means to the Regional Director of Companies, Competition, Consumption, Labour and Employment.

In addition to the information provided for in the third paragraph of article L. 1233-46, the notification shall specify :

1° The name and address of the employer ;

2° The nature of the business and the number of employees in the company or establishment;

3° The number of redundancies envisaged;

4° Where applicable, any changes that need to be made to the information already sent in application of article L. 1233-31 ;

5° If the Social and Economic Committee has recourse to a Chartered Accountant, mention of this decision;

6° Where applicable, the signature of a collective agreement in application of articles L. 1233-21 and L. 1233-24-1. A copy of this agreement is then attached to the notification.

La notification du projet de licenciement prévue à l’article L. 1233-46 est adressée par la voie dématérialisée au directeur régional des entreprises, de la concurrence, de la consommation, du travail et de l’emploi.

Outre les renseignements prévus au troisième alinéa de l’article L. 1233-46, la notification précise :

1° Le nom et l’adresse de l’employeur ;

2° La nature de l’activité et l’effectif de l’entreprise ou de l’établissement ;

3° Le nombre des licenciements envisagés ;

4° Le cas échéant, les modifications qu’il y a lieu d’apporter aux informations déjà transmises en application de l’article L. 1233-31 ;

5° En cas de recours à un expert-comptable par le comité social et économique, mention de cette décision ;

6° Le cas échéant, la signature d’un accord collectif en application des articles L. 1233-21 et L. 1233-24-1. Une copie de cet accord est alors jointe à la notification.
