Article D125-2 of the French Insurance Code

The role of the National Advisory Commission on Natural Disasters provided for in I of article L. 125-1-1 is to issue an annual opinion on:

1° The relevance of the criteria used to determine recognition of the state of natural disaster, based in particular on the annual report produced by the interministerial commission for recognition of the state of natural disaster provided for in II of article L. 125-1-1 of the present code;

2° The actual conditions under which claimants are compensated, based on overall statistical analyses relating in particular to the time taken to compensate, the amount of compensation paid and the number of policyholder declarations for which no compensation was paid;

3° The terms and conditions under which loss adjusters involved in the assessment of damage caused by natural disasters are certified and proposes, where appropriate, any useful measures aimed at changing practices.

Article D125-2

La commission nationale consultative des catastrophes naturelles prévue au I de l’article L. 125-1-1 a pour mission de rendre annuellement un avis sur :

1° La pertinence des critères retenus pour déterminer la reconnaissance de l’état de catastrophe naturelle, en se fondant notamment sur le rapport annuel produit par la commission interministérielle de reconnaissance de l’état de catastrophe naturelle prévu au II de l’article L. 125-1-1 du présent code ;

2° Les conditions effectives de l’indemnisation des sinistrés en se fondant sur des analyses statistiques d’ensemble portant notamment sur les délais d’indemnisation, le montant des indemnisations et le nombre de déclarations d’assurés n’ayant pas donné lieu à indemnisation ;

3° Les modalités et conditions selon lesquelles les experts qui interviennent pour l’évaluation de dommages occasionnés par des catastrophes naturelles sont certifiés et propose, le cas échéant, toutes mesures utiles visant à faire évoluer les pratiques.
