Article D125-3 of the French Insurance Code

The Interministerial Commission for the Recognition of the State of Natural Disaster provided for in II of article L. 125-1-1 issues a simple opinion on each communal request for recognition of the state of natural disaster referred to it by the ministers responsible for civil security, the economy, the budget and overseas departments and territories. Its opinion focuses on the natural nature and abnormal intensity of the event within the meaning of article L. 125-1. This opinion is issued on the basis of technical expert reports submitted by the State services.

The opinion is issued no later than two months after the matter is referred to the commission secretariat, unless the commission requests additional expert reports. In this case, the opinion is issued no later than two months after receipt by the commission secretariat of the additional information requested.

It also issues a simple opinion on the terms and conditions for submitting and examining municipal applications for recognition of the state of natural disasters.

La commission interministérielle de reconnaissance de l’état de catastrophe naturelle prévue par le II de l’article L. 125-1-1 émet notamment un avis simple sur chaque demande communale de reconnaissance de l’état de catastrophe naturelle dont elle est saisie par les ministres en charge de la sécurité civile, de l’économie, du budget et de l’outre-mer. Son avis porte sur le caractère naturel et l’intensité anormale du phénomène au sens de l’article L. 125-1. Cet avis est rendu sur la base de rapports d’expertise techniques transmis par les services de l’Etat.


L’avis est rendu au plus tard deux mois après la saisine du secrétariat de la commission, sauf si cette dernière sollicite des compléments d’expertise. Dans ce cas, l’avis est rendu au plus tard deux mois après réception par le secrétariat de la commission des compléments sollicités.


Elle émet également un avis simple sur les modalités et les conditions de dépôt et d’instruction des demandes communales de reconnaissance de l’état de catastrophes naturelle.
