Article D125-5-9 of the French Insurance Code

For property other than land motor vehicles, in a commune that does not have a plan for the prevention of foreseeable natural risks for the risk that is the subject of an order declaring a state of natural disaster, the excess is adjusted, for property insured by local authorities or their groupings, according to the number of declarations of a state of natural disaster that have been made for the same risk over the five years preceding the date of the new declaration, as follows:

1° First and second determination: application of the deductible;

2° Third determination: doubling of the applicable deductible;

3° Fourth determination: tripling of the applicable deductible;

4° Fifth and subsequent determinations: quadrupling of the applicable deductible.

The provisions of the previous paragraph cease to apply from the time that a plan for the prevention of foreseeable natural risks is prescribed for the risk that is the subject of the declaration of a state of natural disaster in the municipality concerned. They resume their effects if the aforementioned plan is not approved within four years of the date of the order prescribing the natural risk prevention plan.

Pour les biens autres que les véhicules terrestres à moteur, dans une commune non dotée d’un plan de prévention des risques naturels prévisibles pour le risque faisant l’objet d’un arrêté portant constatations de l’état de catastrophe naturelle, la franchise est modulée, pour les biens assurés par les collectivités territoriales ou par leurs groupements, en fonction du nombre de constatations de l’état de catastrophe naturelle intervenues pour le même risque au cours des cinq années précédant la date de la nouvelle constatation, selon les modalités suivantes :

1° Première et deuxième constatation : application de la franchise ;

2° Troisième constatation : doublement de la franchise applicable ;

3° Quatrième constatation : triplement de la franchise applicable ;

4° Cinquième constatation et constatations suivantes : quadruplement de la franchise applicable.

Les dispositions de l’alinéa précédent cessent de s’appliquer à compter de la prescription d’un plan de prévention des risques naturels prévisibles pour le risque faisant l’objet de la constatation de l’état de catastrophe naturelle dans la commune concernée. Elles reprennent leurs effets en l’absence d’approbation du plan précité dans le délai de quatre ans à compter de la date de l’arrêté de prescription du plan de prévention des risques naturels.
