Article D1423-62 of the French Labour Code

At his or her request, an employee who is a member of a labour tribunal and who works a continuous or discontinuous shift, all or part of which is completed between 10 p.m. and 5 a.m., is compensated for the hours devoted to his or her labour tribunal activities under the following conditions:

1° Subject to waiving payment of the allowances provided for in Article D. 1423-56, the councillor obtains that all or part of the time devoted to his industrial tribunal activities entitles him to a corresponding rest period in his post;

2° This rest period, which is taken at the latest during the following month, is deducted from the weekly working time accomplished in the post. The employer will continue to pay the employee all remuneration and corresponding benefits.

The employer is reimbursed in full under the conditions set out in article D. 1423-59.

Sur sa demande, le salarié, membre d’un conseil de prud’hommes, fonctionnant en service continu ou discontinu posté accompli en totalité ou en partie entre 22 heures et 5 heures, est indemnisé des heures consacrées à son activité prud’homale dans les conditions suivantes :


1° Sous réserve de renoncer au versement des allocations prévues à l’article D. 1423-56, le conseiller obtient que tout ou partie du temps consacré à ses activités prud’homales ouvre droit à un temps de repos correspondant dans son emploi ;


2° Ce temps de repos, qui est pris au plus tard dans le courant du mois suivant, s’impute sur la durée hebdomadaire de travail accomplie dans le poste. Il donne lieu au maintien par l’employeur de l’intégralité de la rémunération et des avantages correspondants.


L’employeur est remboursé intégralement dans les conditions prévues à l’article D. 1423-59.
