Article D1423-70 of the French Labour Code

Any difficulty encountered by the director of the court registry or the president of the industrial tribunal in certifying or checking the statement mentioned in articles D. 1423-58 and D. 1423-59, after they have informed each other, is brought to the attention of the first president and the public prosecutor of the court of appeal or the person to whom they have jointly delegated their signature in their capacity as secondary authorising officers. The latter, or their delegate, will determine the amount of the sums due to the employee representative concerned.

Toute difficulté rencontrée par le directeur de greffe ou par le président du conseil de prud’hommes dans la certification ou le contrôle de l’état mentionné aux articles D. 1423-58 et D. 1423-59, après qu’ils se sont informés, est portée à la connaissance du premier président et du procureur général de la cour d’appel ou de la personne à laquelle ils ont conjointement délégué leur signature en leur qualité d’ordonnateurs secondaires. Ces derniers, ou leur délégataire, déterminent le montant des sommes dues au conseiller prud’homme concerné.
