The Public Prosecutor at the judicial court in which there is no investigating division notifies the Public Prosecutor at the court in which this division is located of the offences and investigations brought to his attention as soon as it appears to him that these facts and proceedings are likely to give rise to the opening of an investigation of a criminal nature or with co-investigation.
These two magistrates then work together to determine which one will direct and control the progress of the investigation and which one will decide whether to request the opening of an investigation. They will also work together to determine whether an investigation into a crime punishable by fifteen or twenty years’ imprisonment and committed in the absence of a repeat offence will be opened by the public prosecutor at the judicial court in which there is no investigating judge’s unit. The Public Prosecutor will coordinate their actions where necessary.
