Article D2122-6 of the French Labour Code

The system for centralising the results of the professional elections referred to in articles L. 2122-5 to L. 2122-10 in order to measure the audience of the trade union organisations must:

a) Guarantee the confidentiality and integrity of the data collected and processed;

b) Enable the reliability and completeness of the data collected and consolidated to be ensured through regular checks;

c) Enable the data collected to be consulted by any person.

The full results of each electoral cycle are brought to the attention of the Haut Conseil du dialogue social (High Council for Social Dialogue) so that it can issue the opinion provided for in Article L. 2122-11 to the Minister responsible for labour. The results of the first electoral cycle are transmitted by 31 March 2013 at the latest.

Le système de centralisation des résultats des élections professionnelles mentionnées aux articles L. 2122-5 à L. 2122-10 afin de mesurer l’audience des organisations syndicales doit :


a) Garantir la confidentialité et l’intégrité des données recueillies et traitées ;


b) Permettre de s’assurer, par des contrôles réguliers, de la fiabilité et de l’exhaustivité des données recueillies et consolidées ;


c) Permettre une consultation par toute personne des données recueillies.


Les résultats complets de chaque cycle électoral sont portés à la connaissance du Haut Conseil du dialogue social afin qu’il puisse rendre au ministre chargé du travail l’avis prévu à l’article L. 2122-11. Les résultats du premier cycle électoral sont transmis au plus tard le 31 mars 2013.
