A.-For the application of the second paragraph of article L. 2123-18-2, the deliberation of the municipal council determines the documents that the members of the municipal council must provide for the reimbursement of their expenses. This deliberation must enable the municipality to exercise control, in particular to check that the sum of all the financial aid and any tax credit or reduction from which the elected representative benefits, as well as the reimbursement from the municipality, does not exceed the amount of the service provided.
The deliberation establishes the conditions enabling the municipality to:
1° Ensure that the care for which reimbursement is requested does indeed concern children under the age of sixteen, elderly people, people with disabilities, or people requiring personal assistance whose care by members of the municipal council in their own homes is prevented by attendance at one of the meetings mentioned in article L. 2123-1, by means of supporting documents;
2° To ensure that the custody or assistance took place at the time of one of the meetings referred to in Article L. 2123-1;
3° Ensuring that the services provided by the natural or legal persons involved are regular and declared, on the basis of the supporting documents provided;
4° Ensuring, on the basis of a declaration on honour signed by the elected representative, that the reimbursement is subsidiary in nature: its amount may not exceed the actual remaining costs, after deduction of any financial aid and any tax credit or reduction from which the elected representative benefits elsewhere.
