Article D312-8-2 of the French Monetary and Financial Code

The association or foundation acting in the name and on behalf of a natural person shall specify to the latter the documents required to exercise the right to an account with the Banque de France, as referred to in III of article L. 312-1. It also informs the applicant that the credit institution designated by the Banque de France will examine the supporting documents required and may ask the applicant to provide additional information and documents in application of its obligations in terms of knowing the customer, in particular with regard to the fight against money laundering and the financing of terrorism.

The persons authorised to act on behalf of the association or foundation complete an application form for the exercise of the right to an account signed by the applicant and ensure that the documents provided by the applicant correspond to those required. They send the complete application to the Banque de France the same day.

The associations and foundations act in the name and on behalf of the applicant, without any contribution from the applicant.

L’association ou la fondation qui agit au nom et pour le compte d’une personne physique précise à cette dernière les pièces requises pour l’exercice du droit au compte auprès de la Banque de France, mentionnées au III de l’article L. 312-1. Elle informe également le demandeur que l’établissement de crédit désigné par la Banque de France procédera à l’examen des justificatifs requis et pourra lui demander de lui fournir des informations et documents complémentaires en application des obligations lui incombant en termes de connaissance du client, en particulier au titre de la lutte contre le blanchiment de capitaux et le financement du terrorisme.

Les personnes habilitées à agir pour le compte de l’association ou fondation remplissent un formulaire de demande d’exercice du droit au compte signé par le demandeur et s’assurent que les documents fournis par ce dernier correspondent aux pièces requises. Elles transmettent le jour même à la Banque de France le dossier complet.

Les associations et fondations agissent au nom et pour le compte du demandeur sans contrepartie contributive de sa part.
