Article D49-72 of the French Code of Criminal Procedure

In accordance with the provisions of the fourth paragraph of Article 712-16-2 or the second paragraph of Article 745, whether or not he or she is a civil party, the victim may at any time inform the public prosecutor or the public prosecutor of the court that handed down a custodial sentence that he or she does not wish to be informed of the terms and conditions of enforcement of the sentence and in particular the release of the convicted person or the end of the probationary suspension.

The victim’s request is then forwarded by the public prosecutor to the sentence enforcement judge responsible for monitoring the sentenced person, and is filed in the “victim” section of the individual file provided for in article D. 49-29.

Conformément aux dispositions du quatrième alinéa de l’article 712-16-2 ou du deuxième alinéa de l’article 745, qu’elle soit ou non constituée partie civile, la victime peut à tout moment faire connaître au procureur de la République ou au procureur général de la juridiction ayant prononcé une peine privative de liberté qu’elle demande à ne pas être informée des modalités d’exécution de la peine et notamment de la libération du condamné ou de la fin du sursis probatoire.

La demande de la victime est alors transmise par le ministère public au juge de l’application des peines compétent pour suivre le condamné, et elle est classée dans la cote ” victime ” du dossier individuel prévu par l’article D. 49-29.
