Article L1223-6 of the French Labour Code

The collective agreement at branch or company level providing for the introduction of the export assignment contract sets out in particular:

1° The categories of employees concerned ;

2° The nature of the export assignments concerned and their minimum duration, which may not be less than six months;

3° The compensation in terms of remuneration and redundancy payment granted to the employees, without this payment being less than the amount of the legal redundancy payment awarded in proportion to the time worked, regardless of seniority and the number of employees in the company;

4° Guarantees in terms of training for the employees concerned;

5° The measures required to redeploy the employees.

In the case of an industry-wide collective agreement, it also sets out the size and type of companies concerned.

L’accord collectif de branche ou d’entreprise prévoyant la mise en place du contrat de mission à l’exportation fixe notamment :

1° Les catégories de salariés concernés ;

2° La nature des missions à l’exportation concernées ainsi que leur durée minimale, qui ne peut pas être inférieure à six mois ;

3° Les contreparties en termes de rémunération et d’indemnité de licenciement accordées aux salariés, sans que cette indemnité puisse être inférieure au montant de l’indemnité légale de licenciement attribué à due proportion du temps sans condition d’ancienneté et quel que soit l’effectif de l’entreprise ;

4° Les garanties en termes de formation pour les salariés concernés ;

5° Les mesures indispensables au reclassement des salariés.

S’il s’agit d’un accord collectif de branche, il fixe également la taille et le type d’entreprises concernées.
