Where it proves necessary to prevent or control serious risks to human health :
1° Any natural person or legal entity is required, at the Agency’s request, to provide it with any information it holds relating to such risks;
2° Any public or private medical biology laboratory, as well as any laboratory approved or recognised in application of articles L. 202-1 to L. 202-3 of the Rural and Maritime Fishing Code, any laboratory carrying out expert assessments in application of articles L. 215-9 to L. 215-17 of the Consumer Code, any laboratory carrying out health checks or self-monitoring as provided for in Titles II and III of Book III of Part One of this Code is required to forward to the national reference centres or designated laboratories, the strains of infectious agents or biological material of any origin in its possession relating to such risks. An order of the Minister for Health and, where applicable, of the other ministers concerned, sets the conditions for this transmission;
3° The biological resources collected by the laboratories responsible for microbiological surveillance under the conditions mentioned in 2° of this article are kept in a national collection of biological resources of interest to public health. An order by the Minister for Health sets the list of establishments responsible for the conservation of these resources. A decree in the Conseil d’Etat determines the conditions for their conservation, their availability and the sharing of benefits linked to the use of genetic resources derived from them.
