Article L1451-1-1 of the French Public Health Code

Publicity for meetings of the expert commissions, boards and collegiate bodies mentioned in I of article L. 1451-1 and which are consulted as part of administrative decision-making procedures is organised, as appropriate, by the Ministry of Health or by the authority, establishment or body to which they report or to which they are attached.

To this end, provision is made for

1° The recording of the proceedings and the conservation of these recordings ;

2° Without prejudice, where applicable, to the online dissemination of audiovisual recordings of debates, the drawing up of minutes including the agenda, the report of debates, details and explanations of votes, including minority opinions, and the free online dissemination of these minutes on the websites of the Ministry of Health or the authorities, establishments or bodies mentioned in the first paragraph.

La publicité des séances des commissions, conseils et instances collégiales d’expertise mentionnés au I de l’article L. 1451-1 et qui sont consultés dans le cadre de procédures de décision administrative est organisée, selon le cas, par le ministère de la santé ou par l’autorité, l’établissement ou l’organisme dont ils relèvent ou auprès duquel ils sont placés.

A cette fin sont prévus :

1° L’enregistrement des débats et la conservation de ces enregistrements ;

2° Sans préjudice, le cas échéant, de la diffusion en ligne de l’enregistrement audiovisuel des débats, l’établissement de procès-verbaux comportant l’ordre du jour, le compte rendu des débats, le détail et les explications des votes, y compris les opinions minoritaires, et la diffusion gratuite en ligne de ces procès-verbaux sur les sites internet du ministère de la santé ou des autorités, établissements ou organismes mentionnés au premier alinéa.
