Article L1451-2 of the French Public Health Code

The prohibition provided for in article L. 1453-3, subject to the reservations provided for in articles L. 1453-6 to L. 1453-9, applies to the persons mentioned in article L. 1451-1 as well as to persons who occasionally collaborate in the work of these committees. It is prohibited for the persons mentioned in article L. 1453-5 to offer or propose to these persons the advantages mentioned in this article, subject to the reservations set out in articles L. 1453-6 to L. 1453-9.

The members of the committees and the persons mentioned in the previous paragraph are subject to the provisions of the first paragraph of article L. 4113-13. The obligation set out in the first paragraph of article L. 4113-13 is extended to links with companies operating in the field of competence of the authorities and bodies mentioned in I of article L. 1451-1. In the event of failure to comply with these provisions, the administrative authority may terminate their functions.

Article L1451-2

L’interdiction prévue à l’article L. 1453-3, sous les réserves prévues aux articles L. 1453-6 à L. 1453-9, est applicable aux personnes mentionnées à l’article L. 1451-1 ainsi qu’aux personnes qui collaborent occasionnellement aux travaux de ces commissions. Est interdit le fait, pour les personnes mentionnées à l’article L. 1453-5, de proposer ou d’offrir à ces personnes les avantages cités dans cet article, sous les réserves prévues aux articles L. 1453-6 à L. 1453-9.

Les membres des commissions et les personnes mentionnés à l’alinéa précédent sont soumis aux dispositions du premier alinéa de l’article L. 4113-13. L’obligation prévue au premier alinéa de l’article L. 4113-13 est étendue aux liens avec les entreprises intervenant dans le domaine de compétence des autorités et organismes mentionnés au I de l’article L. 1451-1. En cas de manquement à ces dispositions, l’autorité administrative peut mettre fin à leurs fonctions.
