The consumer is entitled to a reduction in price or rescission of the contract in the following cases:
1° Where the trader refuses to bring the digital content or the digital service into conformity;
2° Where compliance of the digital content or digital service is unjustifiably delayed or if it causes costs or major inconvenience to the consumer;
> 3° Where non-compliance of the digital content or digital service is unjustifiably delayed or if it causes costs or major inconvenience to the consumer
3° Where the non-conformity of the digital content or digital service persists despite the trader’s unsuccessful attempt to bring it into conformity.
The consumer is also entitled to a price reduction or rescission of the contract where the lack of conformity is so serious as to justify an immediate price reduction or rescission of the contract. In such cases, the consumer is not obliged to ask for the digital content or service to be brought into conformity beforehand.
The contract may not be rescinded, however.
However, the contract may not be rescinded if the lack of conformity is minor, which is for the trader to demonstrate. This paragraph shall not apply to contracts where the consumer does not pay a price.
