Article L224-25-29 of the French Consumer Code

The provisions of this section do not deprive the consumer of the right to exercise the action resulting from the warranty for hidden defects as set out in articles 1641 to 1649 of the Civil Code or any other action of a contractual or extra-contractual nature recognised to him by law.

Where a restriction arising from the infringement of the rights of any third party, in particular intellectual property rights, prevents or limits the use of the digital content or digital service in accordance with the provisions of articles L. 224-25-13 and L. 224-25-14, the nullity of the contract or any other action of a contractual or extra-contractual nature may be incurred by application of the provisions of the Civil Code.

Les dispositions de la présente section ne privent pas le consommateur du droit d’exercer l’action résultant la garantie des vices cachés telle qu’elle résulte des articles 1641 à 1649 du code civil ou toute autre action de nature contractuelle ou extracontractuelle qui lui est reconnue par la loi.


Lorsqu’une restriction découlant de la violation des droits de tout tiers, en particulier des droits de propriété intellectuelle, empêche ou limite l’utilisation du contenu numérique ou du service numérique conformément aux dispositions des articles L. 224-25-13 et L. 224-25-14, la nullité du contrat ou toute autre action de nature contractuelle ou extracontractuelle peuvent être encourues par application des dispositions du code civil.
