I.-With the exception of II and III of Article L. 224-25-22, the provisions of this section do not apply to digital content and digital services which are integrated or interconnected with goods within the meaning of the introductory article and which are provided as part of the contract for the sale of these goods, whether such digital content or digital services are provided by the seller or by a third party. Such contracts for the sale of goods are governed by articles L. 217-1 et seq. Where it is not clear that the supply of digital content or a digital service is the subject of a separate contract, this supply is presumed to be covered by the contract for the sale of the goods.
II.-The provisions of this section do not apply to supply contracts relating to the following digital content and digital services:
1° Digital content made available to the general public other than by the transmission of signals, in the context of shows or events, such as digital cinema screenings;
2° Digital content supplied by public sector bodies, understood as any administrative document within the meaning of Articles L. 300-2 et seq. of the Code des relations entre le public et l’administration;
3° Services other than digital services, whether or not the trader uses digital formats or means to create the service product, supply it or transmit it to the consumer;
4° Electronic communications services within the meaning of Article 32(6) of the French Post and Electronic Communications Code, other than non-dial-based interpersonal communications services within the meaning of Article 32(6c);
5° Healthcare, understood as healthcare services provided by healthcare professionals to assess, maintain or restore the state of health;
6° Gambling services, understood as any service involving a stake with pecuniary value, involving where appropriate an element of skill, and provided by electronic means or by any other technology facilitating communication and at the individual request of the recipient of such a service;
7° Financial services, understood as any service relating to banking, credit, insurance, personal pensions, investments and payments, as well as the digital asset services referred to in Articles L. 54-10-1 et seq. of the Monetary and Financial Code;
8° Software under a free and open licence, where the consumer does not pay a price and the personal data provided by the consumer is processed exclusively by the trader to improve the security, compatibility or interoperability of this specific software.
