Article L224-6 of the French Consumer Code

The consumer is only bound by his signature.

By way of derogation from the first paragraph and the first paragraph of Article L. 221-25, if the consumer who moves into a site solicits a supplier and wishes performance of his distance contract to begin before the end of the withdrawal period referred to in Article L. 221-18, the supplier shall obtain the consumer’s express request, by any means, and transmit the contract to the consumer in accordance with Article L. 224-7 accompanied by the withdrawal form referred to in 7° of Article L. 221-5. This provision does not apply to the contracts provided for in article L. 332-7 of the Energy Code.

No sum is due by the customer to the supplier.
No sum shall be owed by the consumer in the event that he exercises his right of withdrawal if his express request has not been received in accordance with the penultimate paragraph of this article or if the supplier has not complied with the information obligation provided for in 9° of article L. 221-5.

Par dérogation au premier alinéa et au premier alinéa de l’article L. 221-25, si le consommateur qui emménage dans un site sollicite un fournisseur et souhaite que l’exécution de son contrat conclu à distance commence avant la fin du délai de rétractation mentionné à l’article L. 221-18, le fournisseur recueille sa demande expresse, par tous moyens, et transmet le contrat au consommateur conformément à l’article L. 224-7 accompagné du formulaire de rétractation mentionné au 7° de l’article L. 221-5. Cette disposition n’est pas applicable aux contrats prévus à l’article L. 332-7 du code de l’énergie.


Aucune somme n’est due par le consommateur en cas d’exercice de son droit de rétractation si sa demande expresse n’a pas été recueillie conformément à l’avant-dernier alinéa du présent article ou si le fournisseur n’a pas respecté l’obligation d’information prévue au 9° de l’article L. 221-5.
