Article L224-63 of the French Consumer Code

As an exception to the provisions of the first paragraph of article L. 133-3 of the French Commercial Code, the limitation period applicable to contracts for the removal of goods concluded between a professional and a consumer is set at ten calendar days from receipt of the goods transported. Reasoned protests made by registered letter within this period are effective even if no reservations were made at the time of delivery. Reservations made by the recipient on delivery and not contested by the carrier dispense with the reasoned protest provided for in this article.

Where the procedure to be followed for making reservations has not been communicated to the consumer under the conditions laid down by ministerial decree, the period provided for in the first paragraph is extended to three months.

Par dérogation aux dispositions du premier alinéa de l’article L. 133-3 du code de commerce, le délai de forclusion applicable aux contrats de transports de déménagement conclus entre un professionnel et un consommateur est fixé à dix jours calendaires révolus à compter de la réception des objets transportés. Les protestations motivées émises par lettre recommandée dans ce délai produisent leurs effets même en l’absence de réserves formulées à la livraison. Les réserves émises par le destinataire à la livraison et non contestées par le transporteur dispensent de la protestation motivée prévue au présent article.


Lorsque la procédure à suivre pour émettre des réserves n’a pas été communiquée au consommateur dans les conditions fixées par arrêté ministériel, le délai prévu au premier alinéa est porté à trois mois.
