Article L231-1 of the French Consumer Code

For the application of articles L. 232-1, L. 232-2, L. 232-3 and L. 232-4, a close link with the territory of a Member State is deemed to be established in particular:
1° If the contract has been concluded in the Member State of the consumer’s habitual residence;
2° If the trader directs his activity towards the territory of the Member State where the consumer resides, provided that the contract falls within the scope of that activity;
3° If the contract was preceded in that Member State by an offer specifically made or by advertising and by acts performed by the consumer which are necessary for the conclusion of that contract;
4° If the contract was concluded in a Member State to which the consumer went following an offer of a trip or holiday made, directly or indirectly, by the seller to induce him to conclude that contract.

Pour l’application des articles L. 232-1, L. 232-2, L. 232-3 et L. 232-4, un lien étroit avec le territoire d’un Etat membre est réputé établi notamment :
1° Si le contrat a été conclu dans l’Etat membre du lieu de résidence habituelle du consommateur ;
2° Si le professionnel dirige son activité vers le territoire de l’Etat membre où réside le consommateur, sous réserve que le contrat entre dans le cadre de cette activité ;
3° Si le contrat a été précédé dans cet Etat membre d’une offre spécialement faite ou d’une publicité et des actes accomplis par le consommateur nécessaires à la conclusion de ce contrat ;
4° Si le contrat a été conclu dans un Etat membre où le consommateur s’est rendu à la suite d’une proposition de voyage ou de séjour faite, directement ou indirectement, par le vendeur pour l’inciter à conclure ce contrat.
