A company agreement concluded under the conditions provided for in the first paragraph of Article L. 2232-12 or, in the absence of a trade union delegate, an agreement between the employer and the social and economic committee, adopted by a majority of the full members of the committee’s staff delegation, defines :
1° The organisation, architecture and content of the economic, social and environmental database;
2° The operating procedures for the economic, social and environmental database, in particular access rights and the level of implementation of the database in undertakings with separate establishments, its medium, consultation and use procedures.
The database includes at least the following themes: social investment, tangible and intangible investment, professional equality between men and women within the company, equity capital, debt, all elements of remuneration for employees and managers, social and cultural activities, remuneration of financial backers, financial flows to the company and the environmental consequences of the company’s activity.
The agreement may also include in the database the information required for the mandatory negotiations provided for in article L. 2242-1, in 1° of article L. 2242-11 or in article L. 2242-13 and for the specific consultations of the social and economic committee provided for in article L. 2312-8 and in sub-section 4.
The organisation, architecture, content and operating procedures of the database are such that they enable the social and economic committee and, where applicable, the trade union delegates to usefully exercise their powers.
In the absence of an agreement as provided for in the first paragraph, a branch agreement may define the organisation, architecture, content and operating procedures of the economic, social and environmental database in companies with fewer than three hundred employees.
