Any breach of the provisions of articles L. 223-1 to L. 223-5 is punishable by an administrative fine of up to €75,000 for a natural person and up to €375,000 for a legal entity.
This fine is imposed under the conditions set out in Chapter II of Title II of Book V.
By way of derogation from the first paragraph of Article L. 522-6, the decision handed down pursuant to this article by the administrative authority responsible for competition and consumer affairs is published at the expense of the person penalised.
The administrative authority responsible for competition and consumer affairs may decide to postpone publication of a decision, to publish it anonymously or not to publish it in any of the following circumstances:
1° Where publication of the decision is likely to cause serious and disproportionate harm to the person concerned;
2° Where publication would be likely to seriously disrupt the course of an investigation or control in progress.
