Article L242-9 of the French Consumer Code

In criminal proceedings brought against the seller, service provider or direct seller, pursuant to the provisions of articles L. 242-5 to L. 242-7-1, a consumer who has brought a civil action shall be entitled to claim before the criminal court a sum equal to the amount of the payments made or the instruments subscribed, without prejudice to any damages.

A l’occasion des poursuites pénales exercées contre le vendeur, le prestataire de services ou le démarcheur, en application des dispositions des articles L. 242-5 à L. 242-7-1 le consommateur qui s’est constitué partie civile est recevable à demander devant la juridiction répressive une somme égale au montant des paiements effectués ou des effets souscrits, sans préjudice de tous dommages et intérêts.
