Article L2441-2 of the French Public Health Code

I. – For its application in New Caledonia and French Polynesia, Article L. 2131-1 is amended as follows:

“1° In III, the words: “a multidisciplinary prenatal diagnosis centre” are replaced by the words: “a consultation providing multidisciplinary care”;

“2° In IV, the words “, where applicable a member of a multidisciplinary prenatal diagnosis centre,” are deleted;

“2° bis In the last paragraph of VI, the words: “a doctor qualified in genetics, who may be a member of a multidisciplinary team” are replaced by the words: “a doctor with a view to a consultation to ensure appropriate care”;

“2° ter In VI bis, the words: “the head of the centre for medically assisted procreation” are replaced by the words: “the doctor for medically assisted procreation”.

“3° VII is replaced by the following provisions:

“VII. – The performance of medical biology tests intended to establish a prenatal diagnosis is subject to compliance with the principles set out in this chapter. ” ;

“4° VIII is deleted. “

II. – For its application in New Caledonia and French Polynesia, 1° of Article L. 2131-1-1 is worded as follows:

” 1° By order made on a proposal from the Agence de la biomédecine, the medical criteria justifying the communication to the pregnant woman and, where applicable, to the other member of the couple, of foetal genetic characteristics with no definite link to the initial indication for the examination mentioned in VI of the same Article L. 2131-1. “

Article L2441-2

I. – Pour son application en Nouvelle-Calédonie et en Polynésie française, l’article L. 2131-1 est ainsi modifié :

” 1° Au III, les mots : ” un centre pluridisciplinaire de diagnostic prénatal ” sont remplacés par les mots : ” une consultation de nature à assurer une prise en charge pluridisciplinaire ” ;

” 2° Au IV, les mots : “, le cas échéant membre d’un centre pluridisciplinaire de diagnostic prénatal, ” sont supprimés ;

” 2° bis Au dernier alinéa du VI, les mots : “ un médecin qualifié en génétique, le cas échéant membre d’une équipe pluridisciplinaire ” sont remplacés par les mots : “ un médecin en vue d’une consultation de nature à assurer une prise en charge adaptée ” ;

” 2° ter Au VI bis, les mots : “ Le responsable du centre d’assistance médicale à la procréation ” sont remplacés par les mots : “ le médecin d’assistance médicale à la procréation ”

” 3° Le VII est remplacé par les dispositions suivantes :

” VII. – La réalisation des examens de biologie médicale destinés à établir un diagnostic prénatal est subordonnée au respect des principes énoncés au présent chapitre. ” ;

” 4° Le VIII est supprimé. “

II. – Pour son application en Nouvelle-Calédonie et en Polynésie française, le 1° de l’article L. 2131-1-1 est ainsi rédigé :

“ 1° Par arrêté pris sur proposition de l’Agence de la biomédecine, les critères médicaux justifiant la communication à la femme enceinte et, le cas échéant, à l’autre membre du couple, des caractéristiques génétiques fœtales sans relation certaine avec l’indication initiale de l’examen mentionné au VI du même article L. 2131-1. ”
