Article L2512-9-1 of the French General Code of Local Authorities

The transfer of powers between the City of Paris and its public establishments entails the transfer of the department or part of the department responsible for its implementation.

The civil servants and contractual agents of the Parisian administrations who fully perform their duties in a department or part of a department transferred in application of the first paragraph are transferred ipso jure, retaining the conditions of status and employment that are theirs.

The transfer may be offered to civil servants and contractual employees of the Parisian administrations working only in part in a department or part of a department transferred. If they refuse, they are, automatically and without time limit, placed at the disposal, on an individual basis and for the part of their duties relating to the department or part of the department transferred, of the mayor or president of the public establishment. For the performance of this part of their duties, they are placed under his functional authority. The terms and conditions of this secondment are governed by an agreement concluded between the City of Paris and the public establishment concerned.

Agents transferred in application of this article shall retain, if they have an interest in doing so, the benefit of the compensation scheme that was applicable to them.

Le transfert de compétences entre la Ville de Paris et ses établissements publics entraîne le transfert du service ou de la partie de service chargé de sa mise en œuvre.

Les fonctionnaires et les agents contractuels des administrations parisiennes qui exercent en totalité leurs fonctions dans un service ou une partie de service transféré en application du premier alinéa sont transférés de plein droit en conservant les conditions de statut et d’emploi qui sont les leurs.

Le transfert peut être proposé aux fonctionnaires et aux agents contractuels des administrations parisiennes exerçant pour partie seulement dans un service ou une partie de service transféré. En cas de refus, ils sont, de plein droit et sans limitation de durée, mis à disposition, à titre individuel et pour la partie de leurs fonctions relevant du service ou de la partie de service transféré, du maire ou du président de l’établissement public. Ils sont placés, pour l’exercice de cette partie de leurs fonctions, sous son autorité fonctionnelle. Les modalités de cette mise à disposition sont réglées par une convention conclue entre la Ville de Paris et l’établissement public concerné.

Les agents transférés en application du présent article conservent, s’ils y ont intérêt, le bénéfice du régime indemnitaire qui leur était applicable.
