Article L253-2 of the French Consumer Code

For its application in the Wallis and Futuna Islands, article L. 232-4 is worded as follows:

“Art. L. 232-4 -Where the parties have chosen the law of a State other than France to govern the contract, the court before which that law is invoked is required to set aside its application in favour of the more protective provisions of the law of the consumer’s habitual residence concerning consumer protection in the distance marketing of financial services. “

Pour son application dans les îles Wallis et Futuna, l’article L. 232-4 est ainsi rédigé :


“ Art. L. 232-4.-Lorsque les parties ont choisi la loi d’un Etat autre que la France pour régir le contrat, le juge devant lequel est invoquée cette loi est tenu d’en écarter l’application au profit des dispositions plus protectrices de la loi de la résidence habituelle du consommateur concernant la protection des consommateurs en matière de commercialisation à distance de services financiers. ”
