Article L3123-4-1 of the French Labour Code

When an employee who has reached the age stipulated in the first paragraph of article L. 161-22-1-5 of the Social Security Code asks to work part-time, he must send his request, under conditions set by decree, to the employer. In the absence of a written and reasoned response within two months of receipt of the request, the employer’s agreement is deemed to have been obtained.

The employer’s refusal is justified by the incompatibility of the working hours requested by the employee with the economic activity of the company.

Lorsqu’un salarié ayant atteint l’âge prévu au premier alinéa de l’article L. 161-22-1-5 du code de la sécurité sociale demande à travailler à temps partiel, il adresse sa demande, dans des conditions fixées par décret, à l’employeur. A défaut de réponse écrite et motivée dans un délai de deux mois à compter de la réception de la demande, l’accord de l’employeur est réputé acquis.


Le refus de l’employeur est justifié par l’incompatibilité de la durée de travail demandée par le salarié avec l’activité économique de l’entreprise.
