In the absence of an agreement mentioned in article L. 3142-32, the following provisions apply:
1° The minimum duration of the leave is six months and the maximum duration is eleven months ;
2° The right to this leave is open to an employee who, on the date of departure for the leave, has been with the company for at least thirty-six months, whether consecutive or not, and who has not benefited from any of the schemes mentioned in the second paragraph of article L. 3142-28 within the company over the previous six years;
3° The conditions and deadlines mentioned in 5° of Article L. 3142-32 are set by decree;
4° The ceilings mentioned in Article L. 3142-29 are set by decree.
