Article L324-8-1 of the French Intellectual Property Code

In the cases provided for by this code, a contract authorising the exploitation of protected works or subject matter concluded by a collective management organisation approved for this purpose by the Minister responsible for culture may, with regard to use on national territory, be extended to rightholders who are not members of this organisation by order of the Minister responsible for culture.

The extension of a contract concluded by an approved collective management organisation for its members entails representation by this organisation, for works or subject matter of the same type, of rightholders who are not members.
The extension of the contract concluded by an approved collective management organisation for its members implies representation by this organisation, for works or protected objects of the same type, of rightholders who are not members. The approved collective management organisation is required to guarantee equal treatment to all the rightholders represented.

Article L324-8-1

Dans les cas prévus par le présent code, un contrat autorisant l’exploitation d’œuvres ou d’objets protégés conclu par un organisme de gestion collective agréé à cet effet par le ministre chargé de la culture peut, en ce qui concerne une utilisation sur le territoire national, être étendu aux titulaires de droits non membres de cet organisme par arrêté du ministre chargé de la culture.

L’extension du contrat conclu par un organisme de gestion collective agréé pour ses membres emporte représentation par cet organisme, pour les œuvres ou les objets protégés de même type, des titulaires de droits qui n’en sont pas membres. L’organisme de gestion collective agréé est tenu de garantir une égalité de traitement à l’ensemble des titulaires de droits représentés.
