Article L324-8-3 of the French Intellectual Property Code

The approval referred to in Article L. 324-8-1 is granted in consideration of:

1° the size of the organisation’s repertoire and the diversity of its members;

2° The professional qualifications of the directors;

3° The human and material resources that the organisation proposes to implement to ensure the management of the rights concerned;

4° The equitable nature of the distribution principles provided for with a view to distributing the sums among the rights holders, whether or not they are members of the organisation.

Article L324-8-3

L’agrément mentionné à l’article L. 324-8-1 est délivré en considération :

1° De l’importance du répertoire de l’organisme et de la diversité de ses associés ;

2° De la qualification professionnelle des dirigeants ;

3° Des moyens humains et matériels que l’organisme propose de mettre en œuvre pour assurer la gestion des droits concernés ;

4° Du caractère équitable des principes de répartition prévus en vue de répartir les sommes entre les ayants droit, qu’ils soient ou non membres de l’organisme.
