Any company may apply a profit-sharing scheme concluded at branch level, provided that the branch agreement has been approved pursuant to article L. 3345-4.
Companies wishing to apply the approved branch agreement shall conclude an agreement to this effect under the conditions provided for in I of article L. 3312-5.
Companies with fewer than fifty employees may opt to apply this scheme by means of a unilateral document signed by the employer, under the conditions provided for in Article L. 2232-10-1, if the branch agreement provides for this possibility and proposes, in the form of a standard agreement indicating the various choices left to the employer, specific stipulations for these companies.
The company agreement or the unilateral adherence document is concluded or signed before the date set in article L. 3314-4 and filed in accordance with the procedures set out in article L. 3313-3.
By way of derogation from articles L. 3345-2 and L. 3345-3 and from the second and last paragraphs of article L. 3313-3, the exemptions provided for in articles L. 3312-4 and L. 3315-1 to L. 3315-3 are deemed to be acquired as soon as the agreement or the unilateral document of adherence to the approved branch agreement is filed and for the duration of its application, provided that this adherence has been concluded or signed within the deadlines mentioned in the penultimate paragraph of this article.
