Article L342-21 of the French Tourism Code

The easement is created by a reasoned decision of the competent administrative authority on a proposal from the deliberative body of the commune, group of communes, département or mixed syndicate concerned, following a survey of the land carried out in the same way as for expropriation. In the event of opposition from the municipal council of an interested municipality, the easement is created by decree of the Conseil d’Etat. The easement file is made available to the public for one month at the town hall of the municipality concerned.

Article L342-21

La servitude est créée par décision motivée de l’autorité administrative compétente sur proposition de l’organe délibérant de la commune, du groupement de communes, du département ou du syndicat mixte intéressé, après enquête parcellaire effectuée comme en matière d’expropriation. En cas d’opposition du conseil municipal d’une commune intéressée, elle est créée par décret en Conseil d’Etat. Le dossier de la servitude est tenu à la disposition du public pendant un mois à la mairie de la commune concernée.
