Article L3631-8 of the French General Code of Local Authorities

The duties of the President of the Metropolitan Council are incompatible with those of the President of a Regional Council or the President of a Departmental Council.

The duties of the President of the Metropolitan Council are also incompatible with those of a member of the European Commission, a member of the Executive Board of the European Central Bank or a member of the Monetary Policy Council of the Banque de France.

If the President of the Metropolitan Council of Lyon holds a position that places him/her in a situation of incompatibility as provided for in the first two paragraphs, he/she will cease to hold his/her position as President of the Metropolitan Council of Lyon, at the latest on the date on which the election or appointment that places him/her in a situation of incompatibility becomes final. If this election or appointment is contested, the incompatibility takes effect from the date on which the court decision confirming the election or appointment becomes final.

Les fonctions de président du conseil de la métropole sont incompatibles avec l’exercice de la fonction de président d’un conseil régional ou de celle de président d’un conseil départemental.

Les fonctions de président du conseil de la métropole sont également incompatibles avec celles de membre de la Commission européenne, de membre du directoire de la Banque centrale européenne ou de membre du Conseil de la politique monétaire de la Banque de France.

Si le président du conseil de la métropole de Lyon exerce une fonction le plaçant dans une situation d’incompatibilité prévue aux deux premiers alinéas, il cesse, de ce fait, d’exercer ses fonctions de président du conseil de la métropole de Lyon, au plus tard à la date à laquelle l’élection ou la nomination qui le place dans une situation d’incompatibilité devient définitive. En cas de contestation de cette élection ou de cette nomination, l’incompatibilité prend effet à compter de la date à laquelle la décision juridictionnelle confirmant l’élection ou la nomination devient définitive.
