Metropolitan councillors are elected by direct universal suffrage under the conditions laid down in the Electoral Code.
The Metropolitan Council sits in Lyon. However, it may meet at any other location in the metropolitan area.
Without prejudice to articles L. 3121-9 and L. 3121-10, the Metropolitan Council shall meet as of right on the first Thursday following its election.
The President of the Metropolitan Council is elected by secret ballot, by an absolute majority of the members of the Metropolitan Council. If this election is not obtained after the first two ballots, a third ballot is held and the election takes place by relative majority. In the event of a tie, the election is won on the basis of age.
The metropolitan council elects the members of the permanent commission. The permanent commission is composed of the president and one or more vice-presidents of the metropolitan council as well as, where applicable, one or more metropolitan councillors. The number of vice-presidents is freely determined by the metropolitan council, without this number exceeding twenty-five vice-presidents and 30% of the number of members of the metropolitan council. The Metropolitan Council may delegate some of its powers to the Standing Committee, with the exception of those mentioned in articles L. 3312-1 to L. 3312-3 and L. 1612-12 to L. 1612-15.
The duties of the President of the Metropolitan Council are incompatible with those of the President of a Regional Council or the President of a Departmental Council. The duties of the President of the Metropolitan Council are also incompatible with those of a member of the European Commission, a member of the Executive Board of the European Central Bank or a member of the Monetary Policy Council of the Banque…
Metropolitan councillors receive an allowance for the actual performance of their duties, set by reference to the amount of the salary corresponding to the terminal gross index of the civil service index scale. .
The Metropolitan Council sets the allowances of its members by deliberation within three months of its first installation. When the Metropolitan Council is renewed, the deliberation setting the allowances of its members takes place within three months of its installation.
