The Minister responsible for consumption or the minister(s) concerned may issue warnings to manufacturers, importers or distributors and ask them to bring the products they offer to the public into compliance with safety rules and then to submit them for inspection, within a specified period and at their own expense, by a body offering guarantees of independence, competence and impartiality appearing on a list set by ministerial order or, failing that, designated by the minister(s) concerned.
When, for a product already on the market, there is sufficient evidence of a danger or when the characteristics of a new product justify this precaution, they may require the professionals concerned to submit, within a specified period and at their own expense, the products they offer to the public to the control of a body presenting guarantees of independence, competence and impartiality designated by the minister(s).
Where a product has not been subjected to the inspection prescribed pursuant to this article, it shall be deemed not to meet the requirements of article L. 421-3 and the Minister may have the inspection carried out automatically, in place of and at the expense of the professionals mentioned in the first paragraph.
