Subsection 1: Specific measures applicable to establishments and products

When, as a result of a failure to comply with the regulations adopted for the application of the provisions of Book IV or a European Union regulation, the operating conditions of an establishment are such that the products manufactured, held or placed on the market present or are likely to present a danger to public health or consumer safety, the authorised officers may order any corrective measures, in particular the…

Any measure taken pursuant to article L. 521-5, may require the operator of the establishment to display, in a place visible from the outside, all or part of this measure.

If it is established that products do not comply with the regulations in force or present or are likely to present a danger to public health or consumer safety, the administrative authority may order by decree one or more of the following measures: suspension of marketing, withdrawal, recall and destruction.

The costs resulting from the implementation of the measures mentioned in article L. 521-7 shall be borne by operators designated by decree.

Any operator who has acquired or transferred all or part of the products and who is aware of the decision referred to in article L. 521-7 is required to inform the operator who supplied it with the products and the operators to whom it sold them.

Where it is found that all or part of the products do not comply with the regulations in force, the authorised agents may order them to be brought into conformity, at the operator’s expense, within a period that they shall set. If compliance is not possible, the administrative authority may order, by decree, that the products be used for other purposes, re-exported or destroyed within a period to be set…
